In a significant boost for African representation in global dispute resolution, renowned Kenyan arbitrator Professor Kariuki Muigua SC, has been appointed as a member of the inaugural Court of Arbitration of the Asian International Arbitration Centre (AIAC).

The appointment announced by the Malaysian Minister for Law and Institutional Reform, Datuk Seri Azalina Othman Said installs Prof. Kariuki Muigua SC and Prof. Emelia Onyema of Nigeria as Africa’s representatives of the Asia’s foremost International Arbitration institution. Prof. Muigua joins a select group of 26 distinguished global experts tasked with steering the newly reformed institution into a new era of transparency and excellence.

A Continental Heavyweight on the Global Stage

Professor Muigua SC appointment is has been hailed as a recognition of his peerless contribution to Alternative Dispute Resolution (ADR) in Africa and beyond. A Senior Counsel (SC) of the Republic of Kenya and the recipient of the 2026 Chambers Global Band 1 ranking, Muigua is often cited as the “pinnacle of arbitration” in Kenya.

Speaking on the appointments, Minister Azalina Othman Said noted:

“The AIAC Court comprises a diverse panel of members with extensive and renowned international and domestic ADR experience. Their roles will be instrumental in reinforcing the AIAC’s stature and contributing to the overall effectiveness of the AIAC Court.”

The Reform: From Director to Court

The establishment of the Court marks a historic shift for the AIAC. Under the new AIAC Suite of Rules 2026, the Centre has moved away from a model where power was centralized in the Director’s office. Instead, a decentralized “Court” model—similar to that of the ICC in Paris—now oversees:

  • Arbitrator Appointments: Ensuring a neutral and merit-based selection process.
  • Technical Review of Awards: Scrutinizing draft awards to ensure they meet the highest global standards before issuance.
  • Institutional Governance: Managing challenges to arbitrators and overseeing the administration of the 2026 Rules.

Why Prof. Kariuki Muigua SC?

Prof. Muigua SC brings a rare blend of academic depth and practical “on-the-ground” experience to the Court. His credentials include:

  • Global Recognition: Consistently ranked in Band 1 by Chambers & Partners (2022–2026).
  • Institutional Leadership: Former CIArb Regional Trustee for Africa and current member of the Permanent Court of Arbitration (PCA) at The Hague.
  • Scholarly Impact: Author of foundational texts such as Alternative Dispute Resolution and Access to Justice in Kenya.

Strengthening the Africa-Asia ADR Corridor

For the African legal fraternity, Muigua’s presence on the AIAC Court is strategic. As trade between African nations and Southeast Asia continues to grow, the need for culturally competent yet internationally standardized dispute resolution is paramount. Prof. Muigua’s expertise in environmental law, natural resources, and commercial disputes ensures that the interests of the Global South are represented in one of Asia’s most influential arbitral seats.
