A former acting Chief Magistrate of Milimani Law Courts, Kenya, Daniel Mudanyi Ochenja has sued the Judicial Service Commission for allegedly dismissing him unlawfully.

Ochenja who was sacked in 2014 during former Chief Justice Willy Mutunga’s term accused JSC of terminating his services before being heard. The litigant was fired for allegedly ordering money placed as cash bail by an accused person be converted into a fine after he changed plea of being guilty in October 2014.

According to his lawyer Jason Okemwa, the petitioner was interdicted while on leave and was not given reasons for the sacking. Okemwa says that Ochenja’s rights to natural justice were violated. The judge has directed that the matter be heard on 20th February 2019.
